1. Acceptance of Terms
By accessing or using Jouzt, whether via our website, mobile app, or any related services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the platform. These Terms incorporate our Privacy Policy and any additional policies published by us from time to time.
2. About Jouzt
Jouzt is a social media platform operated by Novario Pty Ltd, based in Melbourne, Australia. It allows users to create, share, vote on, and engage with content including images, videos, comments, and more. Jouzt also offers optional paid features, subscriptions, and virtual items as described in these Terms.
3. Eligibility
You must be at least 16 years old to use Jouzt. By using the platform, you confirm that you meet this minimum age requirement. If you are under 18, you must have permission from a parent or guardian before making any purchases through the platform.
4. User Accounts
To access most features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials. All activity under your account is your responsibility. You must ensure that the information you provide when registering is accurate and kept up to date.
5. User Conduct
You agree not to engage in any of the following prohibited behaviours:
• Harassment, hate speech, or bullying
• Posting sexually explicit or violent content
• Spamming, phishing, or spreading malware
• Impersonation or misrepresentation
• Violating any applicable law or regulation
• Attempting to manipulate, exploit, or abuse any feature of the platform including engagement metrics, earned rewards, or cosmetic systems
We reserve the right to remove content or suspend accounts that violate these rules or otherwise misuse the platform.
6. Content and Ownership
You retain ownership of the content you post. However, by uploading content to Jouzt, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, distribute, and promote your content within the platform and in connection with Jouzt’s services. This allows us to operate, improve, and promote the platform.
7. Paid Services and Subscriptions
Jouzt may offer paid services including subscriptions, one-time purchases, and access to virtual items. By making a purchase, you agree to the terms set out in this section and throughout these Terms.
7.1 Payment
We use third-party payment processors to handle transactions. By providing a payment method, you confirm that: (a) you have the legal right to use that payment method; (b) all payment information you provide is accurate; and (c) you authorise us to charge your payment method for any amounts due. We are not responsible for fees charged by your financial institution or payment provider.
7.2 Subscriptions
We may offer recurring subscription tiers (such as Jouzt+) that provide access to premium features, virtual items, and other benefits. By purchasing a subscription, you acknowledge and agree that:
• Your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date
• You authorise us to charge your payment method on a recurring basis
• Cancellation takes effect at the end of the current paid period – you will retain access to subscription benefits until that date
• We may change the pricing, features, or content of any subscription tier at any time, with reasonable notice provided where changes are material
• Subscription purchases made through the iOS App Store or Google Play are subject to those platforms’ billing and cancellation policies, and must be cancelled through those platforms directly
7.3 Promotions and Free Trials
We may offer promotions, discounts, or free trials from time to time. Promotional offers are non-transferable, have no cash value, and may be withdrawn or modified at any time. Unless cancelled before the end of a trial or promotional period, your subscription will automatically renew at the standard rate.
7.4 Refunds
Except as required by applicable Australian consumer law, all purchases are non-refundable. This includes subscription fees, one-time purchases, and virtual items. If you believe you are entitled to a remedy under Australian consumer law, please contact us at [email protected].
7.5 Taxes
You are responsible for any taxes, levies, or duties applicable to your purchases under local law. Where required, we will collect and remit applicable taxes on your behalf. Prices displayed may or may not include tax depending on your jurisdiction and will be communicated clearly at the point of purchase.
8. Virtual Items, Cosmetics and Rewards
Jouzt may make virtual items available to users through purchase, subscription, earned rewards, promotional grants, or other means determined by us from time to time (collectively, “Virtual Items”). Virtual Items include but are not limited to avatar cosmetics, profile frames, profile banners, and any other decorative or functional digital assets made available within the platform.
8.1 Limited Licence
When you obtain a Virtual Item, you receive a limited, personal, non-transferable, non-sublicensable licence to use that item solely within the Jouzt platform and solely in connection with the account through which it was obtained. You do not own any Virtual Item, regardless of any consideration paid or effort expended to obtain it. Virtual Items are not property, have no cash value, and cannot be exchanged for money or anything of value outside the platform.
8.2 Earned Rewards
Certain Virtual Items may be unlocked by completing defined actions or milestones on the platform (such as reaching engagement thresholds or maintaining streaks). Earning a Virtual Item through platform activity grants you the same limited licence described in clause 8.1. We reserve the right to modify the conditions under which Virtual Items are earned, add new earnable items, retire existing items, and adjust milestone thresholds at any time. Previously earned items already in your account will not be removed solely due to changes to earning conditions, except as provided in clause 8.4.
8.3 Subscription-Gated Items
Certain Virtual Items may only be accessible while you maintain an active paid subscription. If your subscription lapses, is cancelled, or is terminated, your access to subscription-gated Virtual Items will cease at the end of the paid period or immediately upon termination, depending on the reason. Items earned through platform activity and not gated behind a subscription will not be affected by a subscription lapse unless your account is suspended or terminated.
8.4 Revocation of Licence
We reserve the right to modify, suspend, or revoke your licence to use any Virtual Item at any time if:
• Your account is suspended or terminated for any reason
• You violate these Terms or any platform policy
• The Virtual Item is discontinued, modified, or removed from the platform
• We determine that the Virtual Item was obtained fraudulently or in violation of these Terms
We will not be liable to you for any loss arising from the revocation of a Virtual Item licence in these circumstances.
8.5 Modifications to Virtual Items
We reserve the right to change, update, or discontinue any Virtual Item or category of Virtual Items at any time, including changes to their appearance, functionality, or availability. We may also adjust, retire, or reintroduce items at our discretion. Where a paid item is discontinued, we will use reasonable efforts to provide notice, but are not obligated to provide refunds unless required by law.
9. Collaborative and Commissioned Content
Jouzt may from time to time work with external creators, artists, or third parties to develop Virtual Items or other content for use on the platform (“Collaborative Content”). This clause governs the terms on which such collaborations occur.
9.1 Ownership and IP Assignment
Any creator or party who contributes to or is commissioned to create Collaborative Content for Jouzt agrees that, upon creation or delivery of that content, all intellectual property rights in the Collaborative Content – including copyright, moral rights (to the extent permitted by law), design rights, and any other proprietary rights – are assigned to and vest in Novario Pty Ltd absolutely and worldwide. Where an outright assignment is not possible under applicable law, the creator grants Novario Pty Ltd an irrevocable, perpetual, exclusive, royalty-free, worldwide licence to use, reproduce, modify, distribute, display, sublicense, and commercialise the Collaborative Content in any form and by any means now known or later developed.
9.2 No Ongoing Royalties or Claims
By participating in any collaboration or commission arrangement with Jouzt, the contributing party:
• Waives any claim to ongoing royalties, revenue sharing, or further compensation beyond any amount expressly agreed in writing at the time of the arrangement
• Agrees not to bring any claim against Novario Pty Ltd in connection with the use, modification, commercialisation, or discontinuation of the Collaborative Content
• Acknowledges that Novario Pty Ltd may use, modify, adapt, discontinue, or commercialise the Collaborative Content at its sole discretion without further consent or notice
9.3 Warranties by Contributing Parties
Any creator contributing Collaborative Content warrants that:
• They are the sole author and owner of the content they contribute, or have the full right to contribute it
• The content does not infringe the intellectual property rights, moral rights, or any other rights of any third party
• The content does not contain any unlicensed third-party material
• They have the full authority to assign or licence the rights described in clause 9.1
Any creator who breaches these warranties agrees to indemnify Novario Pty Ltd against any claims, damages, costs, or liabilities arising from that breach.
9.4 Compensation
Collaboration arrangements may or may not involve compensation. Where compensation is agreed, the specific terms will be set out in a separate written agreement or exchange of correspondence between the parties. These Terms govern the intellectual property and licensing aspects of all collaborations, regardless of whether separate compensation terms exist.
9.5 Third-Party Sellers and Content Providers
We may in permit third-party creators or sellers to offer content or Virtual Items through the Jouzt platform. Where we do so, additional terms may apply and will be communicated at that time. Novario Pty Ltd is not responsible for the quality, accuracy, or legality of content offered by third parties, and users obtain such content at their own risk.
10. Account Termination
We may suspend or terminate your account at any time for violating these Terms or any applicable platform guidelines, or at our sole discretion. Termination may result in the removal of your profile, content, and access to all Virtual Items, including those earned, purchased, or otherwise obtained. We are not liable for any loss of Virtual Items or other platform assets resulting from a suspension or termination.
11. Indemnity and Limitation of Liability
You agree to use Jouzt at your own risk. To the fullest extent permitted by law, Novario Pty Ltd and its affiliates, employees, and agents are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Jouzt or its services, including but not limited to loss of access to Virtual Items, earned rewards, or account data.
You agree to indemnify and hold harmless Novario Pty Ltd from any claims, losses, liabilities, damages, expenses, and legal fees arising out of your use of the platform, your content, your breach of these Terms, or your infringement of any rights of a third party.
12. Modifications to These Terms
We may update or modify these Terms at any time. When we do, we will revise the effective date above or notify you through the platform. Your continued use of Jouzt after any changes constitutes your acceptance of the updated Terms. Where changes are material, we will use reasonable efforts to provide advance notice.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of Jouzt will be resolved in the courts of Victoria, Australia.
14. Child Safety and CSAE Policy
Jouzt is committed to user safety, particularly regarding child sexual abuse and exploitation (CSAE).
• Age Restriction: Jouzt is strictly for users aged 16 and over. We require users to confirm their age upon sign-up and restrict access to minors.
• Prohibited Content: We prohibit all forms of content that depict, promote, or reference CSAE, grooming behaviours, or any sexualisation of minors.
• Moderation and Detection: We use automated systems, manual review, and user reports to detect and remove content that violates our standards. CSAE-related violations are prioritised and escalated appropriately.
• Reporting Abuse: Users can report abusive or suspicious content through the app or by contacting us directly. We investigate all reports promptly and may involve law enforcement where appropriate.
• Cooperation with Authorities: Jouzt fully cooperates with law enforcement and complies with legal obligations to report verified CSAE content.
